DiFazio probe still ongoing — Conn.
01:00 AM EST on Friday, January 4, 2008
The Connecticut attorney general’s office and its Department of Consumer Protection are continuing separate investigations of complaints against building contractor Dominic DiFazio, who is a member of the Westerly School Committee, both agencies said yesterday.
DiFazio’s lawyer, Michael P. Lynch, said Wednesday he had been advised in writing by Consumer Protection that an unspecified complaint “was being referred back to the parties to pursue civil remedies.”
“We’re not aware of any” ongoing investigations in Connecticut, Lynch said.
But Consumer Protection spokeswoman Claudette Carveth said yesterday her department was investigating two complaints against the contractor.
And Attorney General Richard Blumenthal said yesterday, “We’ve received a number of complaints and we’re investigating.”’
Neither Carveth nor Blumenthal provided details of the complaints they were scrutinizing.
Meanwhile, the Westerly police have charged DiFazio, owner of Dom DiFazio Contracting, with two felony counts of obtaining money under false pretenses. He is accused of accepting a $2,761.72 down payment from an elderly couple to replace their windows but failing to do the work.
Berryl Kenyon, a spokeswoman for the Rhode Island attorney general’s office, said those allegations were still being reviewed.
A Web site maintained by the Rhode Island Contractors Registration and Licensing Board shows Dom DiFazio Contracting has a valid license as a residential contractor and a current registration that expires Dec. 1, 2008. The site gives zero for the number of claims, and the space after “number of violations” is blank.
Connecticut’s Department of Consumer Protection shows DiFazio has an active registration, valid until Nov. 30, 2008, as a home improvement contractor. A request for information on consumer complaints sent to trade.practices@ct.gov yesterday afternoon did not draw an immediate response.
