Hearing set on Smithfield restaurant’s outdoor entertainment license

SMITHFIELD — For the Euro Café, the honeymoon with the Town Council may come to an end tonight.
After praising owner Elia Nassios in August for improving the Douglas Pike restaurant — Stephen R. Archambault, council president, called it “a renaissance” — the council granted liquor and entertainment licenses, but insisted on keeping a lid on the level of outdoor music to avoid irritating neighbors.
Now the council has scheduled a public hearing for the possible suspension or revocation of the outside entertainment license “for violations of restrictions and conditions imposed on said entertainment license and creating nuisance conditions,” namely, “unreasonable noise levels.”
Councilwoman S. Jean Cerroni warned in August that she had received telephone calls from residents of the Orchard Meadows neighborhood who were concerned that the café would broadcast loud music late at night.
And Norman E. Gauvin, president of the Orchard Meadows Neighborhood Association, told the council, “We wish him well, but our concern is not the liquor license but the entertainment license.” He added that members of his association were content with “a keyboard and some Sinatra.” He voiced concern that expansion of the outdoor music would mean an objectionable sound level, and added, “we need some kind of a cap.”
The council wound up setting a cap at 11 p.m. for outdoor music with, as Cerroni put it, “no big bands.” The café was allowed to play outdoor music until midnight on weekends.
Nassios assured the residents and council members that there would be no problem.
“We have had a piano guy,” he said. “Music is part of happiness. A rock band? No. Nice music — not crazy. I don’t think you would be able to hear it. There is no way anyone in Orchard Meadows will hear it. I want people while they are eating to be able to talk. If it gets louder than that, I will move it inside.”
But hear it someone evidently did.
A complaint sent to the council by a neighbor via e-mail states, “It is after 11 p.m. on Sunday night and I have my windows open to enjoy the beautiful rain-cleaned air. However, I cannot sleep. The music from the café is too loud. I live in Orchard Meadows, and at the far end!”
The writer went on to say that most people go to bed by 10 p.m.
“I read where the owner stated that they would only play dinner music and that his guests will be able to carry on conversations while the music played,” the writer went on. “I doubt his guests can hear each other!”
The hearing is scheduled early on tonight’s agenda. The council is scheduled to convene its session at 7 p.m. at Town Hall.
