WARWICK — Michael P. Baird, 41, who spent two nights at the Adult Correctional Institutions for contempt of court, was released yesterday by Superior Court Judge Jeffrey C. Lanphear.
Baird, owner of Mike’s Professional Tree Service and Baird Properties LLC, both in Coventry, had been jailed Monday for failing to comply with court orders that he stop hauling “earth removals” from his land on Gibson Hill Road near the Connecticut line and that he repair damage his operations caused to the road and wetlands.
Lawyer Nicholas Gorham, representing the town and neighbors who have complained about noise and intimidation, had asked the court to fine and jail him.
Yesterday, Lanphear acknowledged that Baird had served the two-day sentence he ordered and said: “Baird is released. All orders remain in full force.”
Handcuffs were removed and he was free to go.
Baird and Steven Dilibero, substituting for Baird’s lawyer Fred Volpe, declined to answer questions. “We just have no comment,” Dilibero said.
Baird, who was appointed to the Coventry Planning Commission just before the new Town Council took office, paid $1,500 in contempt fees and deposited $25,000 into a court account to ensure compliance.
The orders include returning eight loads of gravel he trucked from his Gibson Hill property, maintaining a 100-foot buffer between his land and his neighbors, staking out his land five acres at a time to grow hay or Christmas trees, restoring a section of the road and stopping the flow of sediments into wetlands. He must allow unannounced inspections.
Baird testified in a Nov. 10 affidavit that he trapped Gorham’s car with his black GMC Yukon and called the police to report that Gorham was on his land. The police advised Baird to let Gorham go.
