lawyers say this is the handwritten plea offer that Assistant Attorney
General William Ferland made to the Derderians on Sept. 7. It says that
prosecutors are recommending 15 years with 4 years to serve with work
release for Michael Derderian, 11 years suspended sentence and three years’
probation, and that the attorney general’s office will take no position
on parole. For Jeffrey Derderian, the offer recommends a 10-year suspended
sentence with 3 years’ probation and 1,000 hours of community service,
which defense lawyer Kathleen M. Hagerty said Ferland agreed to reduce
to 500 hours when she said she thought 1,000 hours was excessive. According
to this handwritten offer, the state was also going to allow the Derderians
to enter a plea of no-contest under Alford which would mean that the Derderians
would acknowledge that the state had enough evidence to convince a jury
they were guilty, but, unlike a regular no contest plea, they were not
admitting guilt. But the Alford plea is not part of the current deal,
Hagerty said.
