I, ______________, make the following statement(s), after having been advised of my rights. I give up my rights. I do not want a lawyer present at this time. I want to talk to the police. I am doing these things voluntarily and without threats or promises by members of the Providence Police Department.

Q. We the Providence Police are investigating a shooting that took place outside Fidas Restaurant located at 270 Valley St. At approx. 0143 hr. On 012899. Can you tell me in your own words what you know about this incident?

A. Yes, I went to Fidas Restaurant with my girl Christa Calder, Brenda Ruiz and Juanita (Jenny)Vazquez. When we arrived at the restaurant Brenda and Jenny went into the restaurant and I stayed in the car with my girl Christa. There was a commotion going on in the restaurant between Brenda, Jenny and some other people in the restaurant. I got out of the car with Christa and I went to the front door of the restaurant to the little hallway and I was trying to pull Brenda out of the hallway but she kept trying to get at the other girl. They were both trying to get at each other they were yelling back and forth I had Brenda and someone else had the other girl. I pulled Brenda outside and then there was screaming outside between the girls and there were a few guys around and another girl there. Brenda got away from and started fighting with the girl and I grabbed her again and I was pulling her away and one of the other girls was holding two long silver things in her hands she was yelling "I can get weapons or something like that" and then I heard a loud bang on my car. I said "yo, who's throwing ---- at my car" the next thing I no I'm being pushed and I'm on top of my car, I got punched in the face. I got into the car and I was ready to pull off, the girls were all getting into the car because I wanted to get out of there. Then the cops pulled up behind me and they got out of the car and they had there guns out and they were yelling at me "get the ---- out of the car" "get on the ------- ground", I had both my hands out the drivers window and the door was open. I started to step out of my girls car and at this time a black guy came out of Fidas Restaurant at the same time as the cops are yelling for me to get on the ground this black guy is yelling something like "freeze or something, he was saying a few things but I couldn't make him out, I was paying more attention to the police officers, I thought the black guy was trying to kill me or something. The policemen were still yelling at me to get on the ground and at the same time they were yelling at the black guy to put his gun down. The black guy is not paying any attention to the cops he yelling at the top of his head but I couldn't hear what he's saying, because the cops are still yelling for me to get on the ground. As I started to go to the ground I heard a few shots and then I threw myself on the ground and was trying to get under the cop car so I wouldn't get shot. The cops put me in cuffs and then they put me into a police car and I was taken to the police station.

Q. The Silver Camaro you were driving belongs to who?

A. Christa Calder my girlfriend.

Q. Was there a gun in the Silver Camaro?

A.Yes, there was a gun in the car but it belonged to my girl.

Q. Did the other girls that arrived, at the restaurant with you know about the gun in the car?

A. I don't know.

Q. I am showing you seventeen photo's do you recognize anyone in these photo's?

A. Number seventeen is a picture of me, number eleven (11) is one of the black guys that jumped me and he's the one who punched me in the face and that's when I ended up on top of my girl car on the front hood, number ten (10) was the girl that was fighting with Brenda and number twelve (12) was the girl that came with the two silver things in her hands. Number six (6) is Brenda, number thirteen (13) is jenny and number fifteen (15) is my girl Christa. The other pictures I don't know they might have been there but I don't know.

Q. The man in picture number eleven (11) is known to the Prov. Police as Alex D. George DOB 120979. Are you positive that this is the man who punched you in the face?

A. Yes, but I don't want to press any charges against him.

Q. The girl in picture number ten (10)is known to the Providence Police as Stephanie Zoglio DOB 040679. Are you positive that she is the girl that was fighting with Brenda?

A. Yes.

Q. The girl in picture number twelve (12) is known to the Providence Police as Diana Villafane DOB 111580. Exactly what did she do?

A. She's the one who had the two silver things in her hands and was yelling something about getting weapons.

Q. When you saw the black guy with the gun come out of the restaurant did he already have the gun in his hand?

A. Yeah, he had it in both hands pointing it at me, but I was trying to obey the cops who were yelling for me to get on the ground, so he was really pointing it at both myself and the cops.

Q. Earlier in your statement you stated that you heard the cops telling the black guy to drop the gun. How many time did you hear the cops tell the black guy to drop the gun?

A. Six or seven times they told him quite a few times but he didn't seem to be paying any attention to the cops, I was just afraid that he was a friend of the guys who jumped me and that he was going to shoot me. I think the police thought the same thing because they kept telling him to "drop it" "drop it" over an over again.

Q. You identified Alex D. George DOB 120979 as one of the black guys that jumped you. How many black guys were jumping you?

A. I can't even be sure that they were all black but I got hit a couple of times while I was trying to get the girls into the car.

Q. When Alex D. George DOB 120979 punched you in the face. Did you pull a gun and point it at him?

A. No.

Q. Did you hear any of the girls that came with you yelling to you to get the gun or the ----, and that's when you pulled the gun out?

A. No, I never pulled the gun out on anyone.

Q. Beside the black guy that came out of the restaurant with a gun. Did you see anyone else with a gun?

A. Just the cops.

Q. When the black guy came out of the resturant with the gun in his hands, did he ever identify himself as a police officer?

A. No, not in any way he just started yelling out "freeze and something else that I couldn't understand.

Q. Is this a true statement given of your own free will without any promises or threats by any member of the Providence Police Department?
A. Yes.
